1. Definitions

The following terms have specific meanings within this agreement:

• "Service" refers to vehicle rental services provided by Aureum, including delivery, collection, insurance, support, and related offerings.
• "Vehicle" means any automobile, SUV, or other motorized transport provided by Aureum for rental purposes.
• "Renter" or "You" indicates the individual or entity entering this rental agreement, including authorized drivers.
• "We," "Us," or "Aureum" designates the service provider operating under the business name Aureum.
• "Rental Period" encompasses the time between vehicle collection and return as specified in your reservation confirmation.
• "Agreement" includes these Terms & Conditions plus any supplementary rental documentation you sign.

2. Acceptance of Terms

By reserving a vehicle, creating an account, or using Aureum's services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not accept these terms, you must not use our services.

You represent that you are at least 21 years of age and possess the legal capacity to enter into binding contracts under the laws of Taiwan. Individuals under 21 or without valid driver's licensing are not permitted to rent vehicles from Aureum.

3. Service Description

Aureum provides luxury vehicle rental services across Taiwan, including but not limited to:

• Short-term and extended vehicle rentals ranging from 24 hours to multiple weeks
• Airport and hotel delivery and collection services
• Comprehensive insurance coverage and roadside assistance
• Navigation equipment with English-language interface
• Multilingual customer support throughout rental period
• Optional chauffeur services and travel itinerary recommendations

Vehicle availability is subject to fleet status at the time of reservation. We reserve the right to substitute comparable vehicles when originally requested models are unavailable due to maintenance, prior reservations, or other operational needs.

4. Reservation and Booking

4.1 Booking Process

Reservations can be made through our website, email, or telephone. A confirmed booking requires receipt of your personal information, driver's license details, payment authorization, and acceptance of these terms.

4.2 Booking Modifications

Changes to reservation dates, vehicle selection, or pickup location must be requested at least 48 hours before the scheduled collection time. Subject to availability, we will accommodate modifications without penalty. Changes requested within 48 hours may incur administrative fees.

4.3 Cancellation Policy

Cancellations made more than 72 hours before pickup time receive full refund of any advance payment. Cancellations within 72-48 hours incur a 25% cancellation fee. Cancellations within 48 hours or no-shows result in forfeiture of the first day's rental charge. Platinum package cancellations within 7 days incur a 50% fee due to dedicated liaison allocation.

5. Driver Requirements

5.1 Licensing and Age

All drivers must be at least 21 years old and hold a valid driver's license issued by their home country. Drivers from countries requiring International Driving Permits must present both the IDP and original national license. Licenses must remain valid throughout the entire rental period.

5.2 Additional Drivers

Additional drivers may be authorized at no extra charge by providing licensing documentation during vehicle collection. All authorized drivers must meet the same age and licensing requirements. Unauthorized drivers are strictly prohibited from operating the vehicle.

5.3 Driver Fitness

You confirm that you and all authorized drivers are physically and mentally capable of safely operating the vehicle. Driving under the influence of alcohol, drugs, or medications that impair judgment is prohibited and constitutes breach of this agreement.

6. Payment Terms

6.1 Pricing and Fees

Rental rates are quoted in New Taiwan Dollars (NT$) and include comprehensive insurance, navigation equipment, delivery services, and 24-hour support. Rates do not include fuel, parking fees, highway tolls, traffic violations, or optional chauffeur services.

6.2 Payment Authorization

A valid credit card in the renter's name is required for payment authorization. We place a security hold on your card upon reservation confirmation. The hold amount equals the rental charge plus an additional security deposit determined by vehicle category and rental duration.

6.3 Billing

Final charges are processed within 48 hours after vehicle return. You will receive an itemized invoice via email detailing rental fees, additional services, damages if applicable, and security deposit release. Charges to your card will reflect "Aureum Taiwan" on your statement.

6.4 Late Returns

Vehicles returned within 2 hours of scheduled time incur no penalty. Returns delayed 2-6 hours are charged at 25% of the daily rate. Returns exceeding 6 hours are billed for an additional full day at the package rate.

7. Vehicle Use and Restrictions

7.1 Permitted Use

Vehicles are provided for lawful personal or business transportation within Taiwan. You agree to operate the vehicle in accordance with all Taiwan traffic laws and regulations, maintain reasonable care and custody, and return it in the same condition received, allowing for normal wear.

7.2 Prohibited Activities

The following uses are strictly forbidden and constitute material breach:

• Operating the vehicle for commercial ride-sharing or delivery services
• Subletting, lending, or otherwise transferring the vehicle to third parties
• Participating in racing, timed driving events, or off-road activities
• Transporting illegal goods, hazardous materials, or excessive cargo
• Smoking in the vehicle interior or transporting pets without authorization
• Crossing international borders or boarding ferries without prior written permission
• Towing other vehicles or pushing disabled automobiles

7.3 Maintenance Obligations

During the rental period, you are responsible for checking and maintaining appropriate fluid levels, tire pressure, and reporting any mechanical concerns immediately. Damage caused by neglect, abuse, or failure to address warning indicators may not be covered by insurance.

8. Insurance and Liability

8.1 Included Coverage

All rental packages include comprehensive insurance covering collision damage, theft, third-party liability, and personal injury protection as required by Taiwan law. Coverage applies when the vehicle is operated by authorized drivers in compliance with this agreement.

8.2 Coverage Exclusions

Insurance does not cover damage or loss resulting from prohibited uses, driver negligence, operation under the influence, unauthorized drivers, intentional damage, or violations of Taiwan traffic laws. You remain liable for deductibles and uncovered damages.

8.3 Accident Procedures

In the event of accident, theft, or damage, you must immediately notify local police, obtain an official incident report, contact our emergency support line, and refrain from admitting fault or making settlement offers. Failure to follow these procedures may void insurance coverage.

9. Vehicle Condition and Inspection

At collection, you will conduct a walk-around inspection with our representative to document existing vehicle condition, exterior damage, interior cleanliness, fuel level, and equipment functionality. You acknowledge responsibility for any damage not noted on the inspection form.

Upon return, the vehicle undergoes final inspection. You are liable for new damage, missing equipment, excessive interior soiling, and fuel shortfall at current market rates plus 20% restocking fee. Cleaning fees for smoke odor or pet residue range from NT$5,000 to NT$15,000 depending on severity.

10. Termination

10.1 Early Termination by Renter

You may terminate the rental early by returning the vehicle to our facility during business hours. Partial refunds are not provided for unused rental days. The security deposit will be refunded subject to final vehicle inspection.

10.2 Termination by Aureum

We reserve the right to immediately terminate this agreement and repossess the vehicle if you violate material terms, provide false information, fail to make required payments, abandon the vehicle, or use it for prohibited purposes. You remain liable for all accrued charges and costs of repossession.

11. Limitation of Liability

To the maximum extent permitted by Taiwan law, Aureum's total liability for any claims arising from this agreement is limited to the total amount paid for the rental. We are not liable for indirect, incidental, consequential, or punitive damages including lost profits, business interruption, or personal injury not directly caused by vehicle defects.

Vehicles are provided in good working order but without warranties regarding fitness for specific purposes. We do not guarantee uninterrupted availability or that vehicles will meet all your expectations.

12. Indemnification

You agree to indemnify and hold harmless Aureum, its employees, and affiliates from all claims, damages, losses, and expenses (including legal fees) arising from your use of the vehicle, violation of this agreement, negligence, or illegal activities. This indemnification survives termination of the rental agreement.

13. Privacy and Data Protection

Personal information collected during the rental process is handled in accordance with our Privacy Policy, which forms part of this agreement. By accepting these terms, you consent to our data processing practices as described in the Privacy Policy.

Vehicle location data collected for emergency assistance purposes is retained only for operational and safety requirements and is not used for tracking or surveillance.

14. Dispute Resolution

14.1 Governing Law

This agreement is governed by the laws of Taiwan. Any disputes arising from or relating to this agreement will be subject to the jurisdiction of courts in Taichung City, Taiwan.

14.2 Informal Resolution

Before initiating formal proceedings, parties agree to attempt good-faith negotiation to resolve disputes. Contact our management team at [email protected] to begin this process.

14.3 Class Action Waiver

Disputes must be brought on an individual basis. You waive any right to participate in class action lawsuits or class-wide arbitration against Aureum.

15. General Provisions

15.1 Entire Agreement

These Terms & Conditions, together with your reservation confirmation and signed rental agreement, constitute the entire understanding between you and Aureum. No verbal representations or prior written materials supersede these terms.

15.2 Severability

If any provision of this agreement is found unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect.

15.3 Waiver

Failure to enforce any provision does not constitute waiver of that provision or our right to enforce it subsequently. Waivers must be in writing to be effective.

15.4 Assignment

You may not assign or transfer your rights or obligations under this agreement. Aureum may assign this agreement to affiliates or successors without notice.

15.5 Force Majeure

Neither party is liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, government actions, labor disputes, or public health emergencies.

16. Changes to Terms

We may update these Terms & Conditions to reflect operational changes, legal requirements, or service modifications. Material changes will be communicated via email at least 30 days before taking effect. Your continued use of services after changes indicates acceptance of updated terms.
